URLhost.net BASIC POLICY & SERVICE GUIDELINES (AUP)

Giddie provides services to clients all around the world.
Giddie has the responsibility to protect each client and provide them with the best services available.
The following guidelines were designed to insure these services.

Content:
All services provided by Giddie may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State, or City law is prohibited.
This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue.
The subscriber agrees to indemnify and hold harmless Giddie from any claims resulting from the use of the service which damages the subscriber or any other party.

Note: Pornography and sex-related merchandising are allowed on any URLhost.net server EXCEPT those on the Game Network. This includes sites that may infur sexual content, or links to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to URLhost.net's servers or any other server on the internet. Links to such materials are also prohibited. Viewing/downloading of such information/data by URLhost.net Internet Access customers is not governed by URLhost.net policy, and is at your own discretion/free-will, and may be governed by your state/federal government.

Examples of non-acceptable content or links

* Pirated software
* "Illegal MP3's"
* Hacker programs or archives
* Warez Sites
* Child Pornography

URLhost.net will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms:
URLhost.net does allow Managed Virtual Hosting clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. We do provide a html based cgi chat room that runs without hindering the performance of the machine for others. You are free to run your own chat script, as long as it does not hinder server performance.

Background Processes/Programs:
URLhost.net may allow Managed Virtual Hosting client's programs to run continually in the background, these are considered on a one to one basis and a extra charge may be incurred based on system resources used and operational maintenance needed.

Cron Jobs:
URLhost.net does allow Cron Jobs to be conducted on our Managed Virtual Hosting servers.

IRC:
URLhost.net currently DOES NOT allow IRC or IRC Scripts to be operated on our servers.
IRC access may be enabled for URLhost.net Dedicated Server customers upon special request.

Multiple Connections:
URLhost.net does not allow multiple dial-in connections on a single dial-up access account.
Multiple telnet and ftp sessions are allowed, on a single hosting account. Multiple computers/networks are permitted on URLhost.net High Speed Wireless & Dedicated Access accounts.

Idle Timeouts:
URLhost.net may disconnect any idle connection to the network.
Average timeouts are:
FTP - 300 seconds
Dial-Up - 10-15 minutes
Telnet - 2 hours

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from a URLhost.net server or using an email address that is maintained on a URLhost.net machine is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.
URLhost.net will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is NOT acceptable

Server Abuse:
Any attempts to undermine or cause harm to a URLhost.net server or customer of URLhost.net is strictly prohibited. URLhost.net will pursue legal action to the fullest extent for all abuse of the URLhost.net Network.

Server Resource Usage:
Any client found to be using more than 6% of any resource of the server he/she is hosted on will be asked to upgrade their account to allow for higher resource consumption. If the client does not wish to be upgraded, account suspension or termination will be the next step. An alternative to this measure will be to remove the script or entity that is causing trouble on the server it is hosted on. Server resources include any of the following: CPU load, RAM usage, HDD space, or massive bandwidth consumption.

Suspension/De-Activation:
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. URLhost.net reserves the right to remove any account without prior notice. If URLhost.net deactivates your account(s) for violating policy, you will forfeit your rights to a refund...and none will be given. No refunds for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.

Proxy Sites:
There will be no sites allowed that serve to provide false information to other websites. This includes proxy services or any sort of redirect that uses our servers IP address as the from location and source. Any scripts of this nature found on URLhost.net's servers will be deleted immediately without warning.

Script Sites:
Because of the scripting resources needed to handle any sort of statistical information hosting site, these types of sites are not allowed. You are allowed to run hosted stats script for your site and sites hosted under your account only. If you are unsure if your script falls into this category, please ask.

In the event we find that there has been a breech of the rules stated in this TOS, we reserve the right to take any of the steps specified below above any other. We will try to follow in order, these disciplinary actions.
1: You will receive one warning and if warranted we will turn off your account until the violation is corrected.
2: For a second violation, your account will be deleted and you will not be allowed access back into our servers and you will not be allowed to re-signup for hosting.

In any event we reserve the right to deny any refund requests and money paid either in advance or up front will be considered compensation for damages.
